1. Scope of Application
The goods on offer at Doc Save®® are exclusively directed at companies as defined by section 14 of the German Civil Code (BGB). Doc Save® provides all services and deliveries to customers based on these terms and conditions. Deviating terms and conditions on the part of the customer in individual cases may become part of the contract only with the express written consent of Doc Save®.

 

2. Conclusion of contract
Goods and price quotes provided by Doc Save® are generally nonbinding. A customer's order constitutes a binding bid that Doc Save® may accept either through an order confirmation or dispatch of the goods within three days.

 

3. Prices
Except where otherwise indicated, the prices on Doc Save® are valid 30 days from date of issue. Prices published by Doc Save® are valid from the forwarding office, shipping and packing not included, unless otherwise agreed.


Doc Save® reserves the right to raise prices, commensurate with cost increase due to currency fluctuations, changes to purchase conditions or material price rises, in contracts with an agreed delivery time in excess of four months. If the increase is more than 5% of the originally agreed prices, the buyer has the right to cancel the order.

 

4. Delivery
Orders are generally processed to the best of Doc Save®'s knowledge and belief. Doc Save® strives to take into consideration the preferences of the buyer. Depending on availability of the goods, orders received by 14:00 are usually dispatched the same workday. Standard delivery time within Germany is one workday, foreign countries two to four workdays. For out of stock goods, Doc Save® will inform the buyer promptly of the anticipated date of delivery. The cost of shipping is free of cost on net orders of €150.00 and over. Orders below this value will be charged €10.00 (to United Kingdom) plus statutory value added tax.

Doc Save® reserves the right to choose the shipping route and the right to dispatch the order in reasonable, separate deliveries, and as such the deliveries will be made generally free of charge to the buyer. Delivery is subject to our being supplied correctly and in due time. Missing the delivery deadline entitles the buyer to set a new, appropriate delivery date. The buyer has the right to withdraw from the contract only when the extended delivery date has been passed due to a delayed delivery or a failure to deliver altogether. This applies exclusively to the undelivered goods, unless the partial fulfillment of the contract is demonstrably of no interest to the buyer.

 

If the goods ordered are dispatched at the buyer's request to their own address, the risk of accidental loss or accidental damage is transferred to the customer at the moment of dispatch or at the latest the moment the goods leave the warehouse. This applies regardless of whether shipment is made from the place of execution or the bearer of the transport costs. 

 

5. Terms of payment
Invoices from Doc Save® shall be due within ten days of receipt without charges being incurred. If payment is delayed, Doc Save® reserves the right to charge interest in the amount of 5% above the current key interest rate of the European Central Bank. The offset or exercise of retention rights is only permissible with undisputed claims or claims which have been validated by due legal process. For payment delays incurred by a buyer who is not a consumer, Doc Save® reserves the right to charge interest in the amount of 8% above the current key interest rate of the European Central Bank.

 

6. Liability due to breach of contract
In the event of violations of contractual or pre-contractual obligations incurred by Doc Save® or its subcontractors, Doc Save® is held liable only for intent or gross negligence. This does not apply to liability for damages resulting from injury to life, body or health. This also does not apply to violation of contractual obligations whose observance of the fulfillment of contractual purposes is of particular significance (cardinal or primary obligations). Liability in the case of breach of the cardinal obligations is limited to foreseeable losses typical to the contract at the time of signing. 

 

7. Warranty for defects
Claims may only be considered if the buyer examines the goods promptly after acceptance of the shipment at the agreed site of delivery - if necessary by means of a trial test - and notifies the defects to Doc Save® immediately upon discovery, latest within ten days of delivery. If the buyer fails to do so or processes or uses the goods, the goods will then be deemed accepted and approved. For a timely notification of a significant defect of the goods at the transfer of risk, Doc Save® will on a case-to-case basis replace the goods free of charge in place of financial compensation to the buyer. If these attempts fail, the buyer may withdraw from the contract or reduce the remuneration. Any claims for damage remain unaffected.

The statute of limitation on validly made claims arising from defects shall lapse 12 months after delivery of goods from Doc Save® to the buyer. Exempt from this rule are claims for damages due to injury to life, body or health, and/or damage claims due to gross negligence or damages intentionally caused by Doc Save®. To this extent, the statute of limitation shall apply.


8. Copyright
The images, text, graphics and videos used on our website are protected by copyright law. The rights of use rest with Doc Save® GmbH. Any use of images, text, graphics or videos is not permissible without prior agreement of the copyright holder. Doc Save® will take legal actions against unauthorized use.


9. Data Protection
In the preparation, finalization, execution and nullification of the contract, data is ascertained, saved and processed by Doc Save® in the scope of the legal provisions. By visiting this website, the IP address, date and time, browser type and operating system of the PC as well as the webpages viewed will be recorded. This process is anonymous and does not allow inferences to be drawn on personal data. Personal data, e.g. name and contact information, which the buyer makes available to Doc Save®, are to be used only for correspondence with the buyer and for the purpose of processing. Doc Save® will only disclose the buyer's data to the shipping firm for the purpose of delivering the goods. Doc Save® discloses relevant data to the authorized banking institution for the purpose of processing payments. Doc Save® ensures personal data will not be disclosed to third parties unless Doc Save® is required by law or the buyer has given prior consent. In the event Doc Save® retains third-party service providers for the purpose of implementation and handling of processing procedures, the provisions of the Federal Law on Data Protection will be observed. Personal data entrusted to Doc Save® via this website will be saved for only as long as necessary for the purposes intended. Statutory storage periods regulated by commercial and/or tax law may mean that certain data be required to be saved for a maximum of 10 years.

In the event that the contract partner rescinds their consent to the saving of personal data or if this has changed, Doc Save® will remove, correct or block the buyer’s data in accordance to legal requirements. Upon request, Doc Save® will provide free of charge information regarding all personal data that Doc Save® has saved on the buyer. This website uses Google Analytics, a Web analysis service of Google Inc. (Google). 10. Place of business, legal domicile, applicable law
Place of business and sole jurisdiction for all disputes stemming from this contract is Berlin. This contract is subject to German law. The execution of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded.
